These terms govern your use of the South Africa Guide & Planner website, the digital Guide, the Planner and the AI travel guide (together, "the service"). The service is provided by Johan Hartzenberg, an individual based in South Africa ("we", "us"). When you use or buy the service you are contracting with Johan Hartzenberg.
By creating an account, buying a product or continuing to use the service, you agree to these terms.
What the service is
The Guide is a digital travel publication about South Africa. The Planner is a planning and estimating tool: it suggests routes, nights and pace and produces cost estimates. It never makes bookings, reservations or payments to travel suppliers on your behalf. All estimates are approximate and are not quotes. You are responsible for checking prices, availability, opening times, visa, health and safety requirements with the relevant suppliers and authorities before you travel or book.
Eligibility and your account
- You must be at least 18, or have the permission of a parent or guardian.
- Give accurate information and keep it up to date.
- Keep your sign-in details confidential; you are responsible for activity on your account.
Payments
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax and refund mechanics are governed by the Paddle Buyer Terms. Products are one-time purchases giving lifetime access to the product bought for as long as the service operates.
Licence
We grant you a personal, non-exclusive, non-transferable licence to use the products you have bought. You may not resell, share, copy, redistribute or publish the Guide content, reverse engineer the service, or circumvent access controls.
Acceptable use
You must not misuse the service, including by:
- using it for anything unlawful, fraudulent or for spam;
- infringing our or anyone else's intellectual property;
- interfering with its security — introducing malware, probing, scraping or overloading it.
The AI travel guide
- Do not use it to create illegal, hateful, harassing or deceptive content, malware, or to attempt to bypass its safeguards.
- You are responsible for what you ask and how you use the answers. Answers can be wrong or out of date; verify anything important. It is not legal, medical, financial or immigration advice.
- You keep any rights in what you type. We may moderate, filter or refuse responses.
- Rights-holders who believe content infringes their rights can contact johanhartz@icloud.com; repeated infringement leads to account suspension.
Intellectual property
We own the service and all its content, software, design and branding. Nothing in these terms transfers ownership to you.
Availability
We work to keep the service running, but we do not guarantee it will be uninterrupted or error-free, and we may change features over time.
Suspension and termination
We may suspend or end your access for a material breach of these terms, non-payment or chargebacks, security or fraud risk, or repeated or serious policy violations. You can stop using the service and ask us to delete your account at any time.
Liability
To the fullest extent permitted by law, the service is provided "as is" without implied warranties. We are not liable for indirect or consequential losses, or for decisions, bookings or travel you make based on the service. Our total liability is limited to the amount you paid us in the 12 months before the claim. Nothing limits liability for fraud, death or personal injury where the law does not allow it.
Law
These terms are governed by the laws of the Republic of South Africa, and disputes go to its courts, without removing any consumer rights you have where you live.
